However, Meyers recognized one of the names in the collage, "Antonio Scalywag," as a person who had previously criticized him online. This recognition led Meyers to request an investigation into the authenticity of Patel's claims according to ABC13. The Fort Bend District Attorney’s Office launched a probe in October, subpoenaing Facebook and Google to trace the origin of the fake account.

The investigation revealed that the fake account was linked to Patel, with authorities uncovering connections to his address, phone number, and bank card information. As a result, Patel was arrested by Texas Rangers for third-degree felony online impersonation and a Class A misdemeanor for misrepresentation of identity. He was briefly held in Fort Bend County Jail before posting bond, set at $20,000 for the felony charge and $2,500 for the misdemeanor. Patel is scheduled to appear in court on July 22.

Patel’s campaign website highlights his previous roles, including positions with the Department of Justice's Criminal Division in the Public Integrity Section, and as a chief of staff for Fort Bend County. In his controversial Facebook post, Patel accused former President Donald Trump and the current Republican Party of inciting fear and hatred against immigrants. "These hateful images... are from a place of deep and misguided fear – incited by people like former President Donald Trump, and today’s extremist Republican party," Patel wrote.
